Special Counsel Jack Smith in August 2023 accused the Republican of "using false claims of election fraud to obstruct the government function", subverting Joe Biden's win and to cling on to power himself, which then led to the January 6 Capitol riots. He had also attempted to bring a second case against Trump, accusing the incoming president of illegally retaining classified documents after leaving office in 2021. The 78-year-old had pleaded not guilty. However, Mr Smith on Monday (local time) filed a motion to drop all four felony charges against Trump, after he beat Kamala Harris in the election last month. A longstanding policy in US Justice Department states sitting presidents should not be prosecuted, meaning the special counsel had to withdraw the charges. "After careful consideration, the department has determined (the Office of Legal Counsel's) prior opinions concerning the Constitution's prohibition on federal indictment and prosecution of a sitting president apply to this situation and as a result this prosecution must be dismissed before the defendant is inaugurated," he wrote. "That prohibition is categorical and does not turn on the gravity of the crimes charged, the strength of the government's proof, or the merits of the prosecution, which the government stands fully behind." Trump during the election campaign said he would fire Mr Smith and the attorneys who worked with him "within two seconds" if he came back for a second term. The incoming president's spokesman Steven Cheung on Monday (local time) described the file of the motion as a "major victory for the rule of law". "The American People and President Trump want an immediate end to the political weaponisation of our justice system and we look forward to uniting our country," he said. Trump, who as president will again oversee the Justice Department, was expected to order an end to the federal 2020 election case and an attempt by Mr Smith to revive a second case accusing him of illegally retaining classified documents after leaving office.
