By Wendy Fry | CalMatters If you’ve hunted for apartments recently and felt like all the rents were equally high, you’re not crazy: Many landlords now use a single company’s software — which uses an algorithm based on proprietary lease information — to help set rent prices. Federal prosecutors say the practice amounts to “an unlawful information-sharing scheme” and some legislators throughout California are moving to curb it. San Diego’s city council president is the latest to do so, proposing to prevent local apartment owners from using the pricing software, which he maintains is driving up housing costs. San Diego’s proposed ordinance, now being drafted by the city attorney, comes after San Francisco supervisors in July enacted a similar, first-in-the-nation ban on “the sale or use of algorithmic devices to set rents or manage occupancy levels” for residences. San Jose is considering a similar approach. And California and seven other states have also joined the federal prosecutors’ antitrust suit , which targets the leading rental pricing platform, Texas-based RealPage. The complaint alleges that “RealPage is an algorithmic intermediary that collects, combines, and exploits landlords’ competitively sensitive information. And in so doing, it enriches itself and compliant landlords at the expense of renters who pay inflated prices...” But state legislators this year failed to advance legislation by Bakersfield Democratic Sen. Melissa Hurtado that would have banned the use of any pricing algorithms based on nonpublic data provided by competing companies. She said she plans to bring the bill back during the next legislative session because of what she described as ongoing harms from such algorithms. “We’ve got to make sure the economy is fair and ... that every individual who wants a shot at creating a business has a shot without being destroyed along the way, and that we’re also protecting consumers because it is hurting the pocketbooks of everybody in one way or another,” said Hurtado. RealPage has been a greater impetus for all of the actions. The company counts as its customer landlords with thousands of apartment units across California. Some officials accuse the company of thwarting competition that would otherwise drive rents down, exacerbating the state’s housing shortage and driving up rents in the process. “Every day, millions of Californians worry about keeping a roof over their heads and RealPage has directly made it more difficult to do so,” said California Attorney General Rob Bonta in a written statement. A RealPage spokesperson, Jennifer Bowcock, told CalMatters that a lack of housing supply, not the company’s technology, is the real problem — and that its technology benefits residents, property managers, and others associated with the rental market. The spokesperson later wrote that a “misplaced focus on nonpublic information is a distraction... that will only make San Francisco and San Diego’s historical problems worse.” As for the federal lawsuit, the company called the claims in it “devoid of merit” and said it plans to “vigorously defend ourselves against these accusations.” “We are disappointed that, after multiple years of education and cooperation on the antitrust matters concerning RealPage, the (Justice Department) has chosen this moment to pursue a lawsuit that seeks to scapegoat pro-competitive technology that has been used responsibly for years,” the company’s statement read in part. “RealPage’s revenue management software is purposely built to be legally compliant, and we have a long history of working constructively with the (department) to show that.” The company’s challenges will only grow if pricing software becomes another instance in which California lawmakers lead the nation. Following San Francisco’s ban, the Philadelphia City Council passed a ban on algorithmic rental price-fixing with a veto-proof vote last month. New Jersey has been considering its own ban. According to federal prosecutors, RealPage controls 80% of the market for commercial revenue management software. Its product is called YieldStar, and its successor is AI Revenue Management, which uses much of the same codebase as YieldStar, but has more precise forecasting. RealPage told CalMatters it serves only 10% of the rental markets in both San Francisco and San Diego, across its three revenue management software products. Here’s how it works: In order to use YieldStar and AIRM, landlords have historically provided RealPage with their own private data from their rental applications, rent prices, executed new leases, renewal offers and acceptances, and estimates of future occupancy, although a recent change allows landlords to choose to share only public data. This information from all participating landlords in an area is then pooled and run through mathematical forecasting to generate pricing recommendations for the landlords and for their competitors. The San Diego council president, Sean Elo-Rivera, explained it like this: “In the simplest terms, what this platform is doing is providing what we think of as that dark, smoky room for big companies to get together and set prices,” he said. “The technology is being used as a way of keeping an arm’s length from one big company to the other. But that’s an illusion.” In the company’s own words, from company documents included in the lawsuit, RealPage “ensures that (landlords) are driving every possible opportunity to increase price even in the most downward trending or unexpected conditions.” The company also said in the documents that it “helps curb (landlords’) instincts to respond to down-market conditions by either dramatically lowering price or by holding price.” Providing rent guidance isn’t the only service RealPage has offered landlords. In 2020, a Markup and New York Times investigation found that RealPage, alongside other companies, used faulty computer algorithms to do automated background checks on tenants. As a result, tenants were associated with criminal charges they never faced, and denied homes. Thirty-one-year-old Navy veteran Alan Pickens and his wife move nearly every year “because the rent goes up, it gets unaffordable, so we look for a new place to stay,” he said. The northeastern San Diego apartment complex where they just relocated has two-bedroom apartments advertised for between $2,995 and $3,215. They live in an area of San Diego where the U.S. Justice Department says information-sharing agreements between landlords and RealPage have harmed or are likely to harm renters. The department in August filed its antitrust lawsuit against RealPage, alleging the company, through its legacy YieldStar software, engaged in an “ unlawful scheme to decrease competition among landlords in apartment pricing ”. The complaint names specific areas where rents are artificially high. Beyond the part of San Diego where Pickens lives, those areas include South Orange County, Rancho Cucamonga, Temecula, and Murrieta and northeastern San Diego. In the second quarter of 2020, the average rent in San Diego County was $1,926, reflecting a 26% increase over three years, according to the San Diego Union-Tribune . Rents have since risen even more in the city of San Diego, to $2,336 per month as of November 2024 – up 21% from 2020, according to RentCafe and the Tribune. That’s 50% higher than the national average rent. The attorneys general of eight states, including California, joined the Justice Department’s antitrust suit, filed in U.S. District Court for the Middle District of North Carolina. The California Justice Department contends RealPage artificially inflated prices to keep them above a certain minimum level, said department spokesperson Elissa Perez. This was particularly harmful given the high cost of housing in the state, she added. “The illegally maintained profits that result from these price alignment schemes come out of the pockets of the people that can least afford it.” Renters make up a larger share of households in California than in the rest of the country — 44% here compared to 35% nationwide. The Golden State also has a higher percentage of renters than any state other than New York, according to the latest U.S. Census data . San Diego has the fourth-highest percentage of renters of any major city in the nation . The recent ranks of California legislators, however, have included few renters: As of 2019, CalMatters could find only one state lawmaker who did not own a home — and found that more than a quarter of legislators at the time were landlords. Studies show that low-income residents are more heavily impacted by rising rents. Nationally between 2000 and 2017, Americans without a college degree spent a higher percentage of their income on rent. That percentage ballooned from 30% to 42%. For college graduates, that percentage increased from 26% to 34%. “In my estimation, the only winners in this situation are the richest companies who are either using this technology or creating this technology,” said Elo-Rivera. “There couldn’t be a more clear example of the rich getting richer while the rest of us are struggling to get by.” Private equity giant Thoma Bravo acquired RealPage in January 2021 through two funds that have hundreds of millions of dollars in investments from California public pension funds, including the California Public Employees’ Retirement System, the California State Teachers’ Retirement System, the Regents of the University of California and the Los Angeles police and fire pension funds, according to Private Equity Stakeholder Project. “They’re invested in things that are directly hurting their pensioners,” said K Agbebiyi, a senior housing campaign coordinator with the Private Equity Stakeholder Project, a nonprofit private equity watchdog that produced a report about corporate landlords ‘ impact on rental hikes in San Diego. RealPage argues that landlords are free to reject the price recommendations generated by its software. But the US Justice Department alleges that trying to do so requires a series of steps, including a conversation with a RealPage pricing adviser. The advisers try to “stop property managers from acting on emotions,” according to the department’s lawsuit. AUSTIN, Texas — State lawmakers are reviving an effort to allow the State of Texas to govern the city of Austin. State Rep. Briscoe Cain , a Republican from Deer Park, filed House Bill 274 ahead of the upcoming legislative session. It would allow the legislature to create a "District of Austin." It is a bill that state lawmakers have introduced before, but it has never gained traction. In a press release, Cain cited bad governing, homicide rates, violent crime and other public safety-related concerns as reasons for "Austin's declining ability to govern as the state capital effectively." He said it highlights "systemic leadership failures, compounded by the defunding of police and policies that deprioritize public safety, leaving the state capital exposed to unacceptable risks." "Our state employees and visitors to the Capitol deserve to feel safe," Cain said in a statement . "The City of Austin has failed to govern responsibly, and its negligence endangers those who come here to serve Texans and our constituents who participate in state government." By sheer numbers, Austin has seen an uptick in homicides since the pandemic, spiking to 88 homicides per year in 2021. The annual number, however, has stayed below that level in the years since. So far this year, the Austin Police Department said it has investigated 65 homicides , which is not far off of last year's total of 73. Looking at that data compared to population growth, the homicide rate rose to about nine people killed per 100,000 residents in 2021, and that number has been hovering between six and eight homicides per 100,000 residents in the years since. The legislation would establish the District of Austin from the current boundaries of the city of Austin. The district would follow the current laws in Austin. However, state lawmakers would have the power to amend or repeal laws, ordinances or policies they do not like. The Lieutenant Governor and Speaker of the House would need to approve any amendment to the district's charter. Cain proposed the bill back in 2021, but it did not pass. State Rep. Jared Patterson proposed a similar bill in 2023 that also failed in committee. In a post on X on Monday, Cain said he felt compelled to re-file it this year. This is a sort of a wish list kind of thing for Republicans over the last couple of legislative sessions," Scott Braddock, editor of the Quorum Report, said. "This is virtue signaling from Republicans. They argue that Austin is too liberal and sucks, so the state of Texas, which Republicans run, should run it instead." The resolution is a constitutional amendment to allow the Legislature to create a district that serves as the seat of government. If it were to pass the Legislature, it would still need to be approved by voters. But Braddock said there is almost no chance it would get that far. "Two-thirds of the members of the Texas House and Texas Senate would have to vote for it, and then it would be voted on by the people of Texas," Braddock said. "The problem with that, for Republicans, is that there are no Democrats who would vote for this, certainly not enough to get to 100 votes in the Texas House, which is a requirement for this to pass." Austin is a home-rule city, meaning it operates under a charter. That city charter is considered Austin's constitution. In response, Austin Mayor Kirk Watson cited the fact that U.S. News and World Report named Austin one of the best places to live based on the high quality of life, strong job market and overall desirability and value. "Austin is a pretty great town. It's a great town to start a career or business," Watson said in a statement. "It's a great town for innovators and people who are vibrant, vital and looking to the future with new ideas. It's a great town to have fun, enjoy good food and even better music." Watson also pointed out that the Milken Institute ranked Austin as the best-performing large city in 2024. He said the proposed bill from state lawmakers would not do much to address the challenges the city is facing. "The Texas Legislature has been hostile to all Texas cities in recent years, but it's long had a special and unnecessary antipathy for its state capital," Watson said. "It's been an effective political tool for some in control of the Capitol but isn't particularly helpful when we're actually trying to solve our shared problems." Cain said the city's "focus on controversial political initiatives rather than infrastructure and public service has raised questions about its ability to manage the responsibilities of hosting the state capital." "This is about more than governance – it's about safety, accountability, and protecting the integrity of Texas' state government," Cain said in a statement. "Austin's failures are not just an embarrassment; They threaten the people who live and work here and the citizens who visit. The District of Austin will provide the focused, accountable leadership necessary to address these challenges head-on." Research is underway to find out what is holding back female participation in local councils, with recommendations to correct gender imbalance expected next year. Only 27 per cent of candidates in this year’s local council elections were female, with just over a quarter (28%) of those candidates elected, said Equality junior minister Rebecca Buttigieg and Local Government junior minister Alison Zerafa Civelli on Saturday. There are currently six localities that do not have any female councillors at all, Buttigieg noted while stressing the importance of female perspectives in local council discussions. The research, which is being carried out by University of Malta Pro-Rector for Student and Staff Affairs and Outreach Carmen Sammut, follows a recommendation earlier this year from a technical committee that evaluated candidacy in the local council elections. Sammut said the parliamentary gender corrective mechanism first seen in the general election two years ago could not necessarily be carried across to local council elections, with her research intended to find other methods of ensuring gender parity. Civelli said Sammut’s research – which is due to be concluded by next September – should be joined by “other activities that are encouraging the further increase of the visibility of women in political life”. Saturday’s press conference comes seven months after Equality Commissioner Renee Laiviera the government reform local councils to make them more gender inclusive. Speaking in April, Laiviera said: “Our biggest challenge is not that people don’t vote for female candidates but a lack of female candidates”. The Japanese government said Sunday’s ceremony will pay tribute to “all workers” who died at the mines, but without spelling out who they are — part of what critics call a persistent policy of whitewashing Japan's history of sexual and labor exploitation before and during the war. The ceremony, which was supposed to further mend their wounds, renewed tensions between the two sides. On Saturday, South Korea's government said it will boycott the memorial service due to unspecified disagreements with Tokyo over the event. There was no immediate response from Japanese officials. Ahead of the ceremony on Sunday, The Associated Press explains the Sado mines, their history and the controversy. What are the Sado gold mines? The 16th century mines on the island of Sado, about the size of the Pacific island of Guam, off the western coast of Niigata prefecture, operated for nearly 400 years beginning in 1601 and were once the world’s largest gold producer. They closed in 1989. During the Edo period, from 1600 to 1868, the mines supplied gold currency to the ruling Tokugawa Shogunate. Today, the site has been developed as a tourist facility and hiking site where visitors can learn about the changes in mining technology and production methods while looking at the remains of mine shafts and ore dressing facilities. Critics say the Japanese government only highlights the glory of the mines and covers up its use of Korean victims of forced labor and their ordeals. The mines were registered as a cultural heritage site in July after Japan agreed to include an exhibit on the conditions of Korean forced laborers and to hold a memorial service after repeated protests from the South Korean government. What's the controversy? At the July meeting of the UNESCO World Heritage Committee, the Japanese delegate said Tokyo had installed new exhibition material to explain the “severe conditions of (the Korean laborers’) work and to remember their hardship.” Japan also acknowledged that Koreans were made to do more dangerous tasks in the mine shaft, which caused some to die. Those who survived also developed lung diseases and other health problems. Many of them were given meager food rations and nearly no days off and were caught by police if they escaped, historians say. But the Japanese government has refused to admit they were “forced labor.” South Korea had earlier opposed the listing of the site for UNESCO World Heritage on the grounds that the Korean forced laborers used at the mines were missing from the exhibition. South Korea eventually supported the listing after consultations with Japan and Tokyo’s pledge to improve the historical background in the exhibit and to hold a memorial that also includes Koreans. Historians say Japan used hundreds of thousands of Korean laborers, including those forcibly brought from the Korean Peninsula, at Japanese mines and factories to make up for labor shortages because most working-age Japanese men had been sent to battlefronts across Asia and the Pacific. About 1,500 Koreans were forced to work at the Sado mines, according to Yasuto Takeuchi, an expert on Japan’s wartime history, citing wartime Japanese documents. The South Korean government has said it expects Japan to keep its pledge to be truthful to history and to show both sides of the Sado mines “The controversy surrounding the Sado mines exhibit underscores a deeper problem” of Japan’s failure to face up to its wartime responsibility and its growing “denialism” of its wartime atrocities, Takeuchi said. Who does the ceremony commemorate? All workers who died at the Sado mines will be honored. That includes hundreds of Korean laborers who worked there during Japan’s 1910-1945 colonization of the Korean Peninsula. Officials say the ceremony is organized by a group of local Japanese politicians, business owners and other volunteers who campaigned for the Sado mines to win the UNESCO status, but preparations were handled by local government officials, who did not disclose details, including guests and programs, until the last minute. Foreign Minister Takeshi Iwaya announced the ceremony on Friday, but he declined to comment on “diplomatic exchanges.” Officials at Sado city and the Foreign Ministry said about 100 people, including officials from Japan’s local and central government, as well as South Korean Foreign Ministry officials and the relatives of Korean wartime laborers, have been invited. Attendants are expected to observe a moment of silence for the victims who died at the mines due to accidents and other causes. The ceremony dredged up long-standing frustrations in South Korea, where the Foreign Ministry said in a statement it was impossible to settle the disagreements between both governments before the planned event on Sunday, without specifying what those disagreements were. Some South Koreans had criticized the Seoul government throwing its support behind an event without securing a clear Japanese commitment to highlight the plight of Korean laborers. There were also complaints over South Korea agreeing to pay for the travel expenses of Korean victims’ family members who were invited to attend the ceremony. How has Japan faced up to its wartime atrocities? Critics say Japan’s government has long been reluctant to discuss wartime atrocities. That includes what historians describe as the sexual abuse and enslavement of women across Asia, many of them Koreans who were deceived into providing sex to Japanese soldiers at frontline brothels and euphemistically called “comfort women,” and the Koreans who were mobilized and forced to work in Japan, especially in the final years of World War II. Korean compensation demands for Japanese atrocities during its brutal colonial rule have strained relations between the two Asian neighbors, most recently after a 2018 South Korean Supreme Court ruling ordered Japanese companies to pay damages over their wartime forced labor. Japan’s government has maintained that all wartime compensation issues between the two countries were resolved under the 1965 normalization treaty. Ties between Tokyo and Seoul have improved recently after Washington said their disputes over the historical issues were hampering crucial security cooperation as China’s threat grows in the region. Japan's whitewashing of wartime atrocities has risen since the 2010s, particularly under the past government of revisionist leader Shinzo Abe. For instance, Japan says the terms “sex slavery” and “forced labor” are inaccurate and insists on the use of highly euphemistic terms such as “comfort women” and “civilian workers” instead. South Korea’s conservative President Yoon Suk Yeol announced in March 2023 that his country would use a local corporate fund to compensate forced labor victims without demanding Japanese contributions. Japan’s then-Prime Minister Fumio Kishida later expressed sympathy for their suffering during a Seoul visit. Security, business and other ties between the sides have since rapidly resumed. Takeuchi said listing Japan’s modern industrial historical sites as a UNESCO World Heritage is a government push to increase tourism.
