Dr Boon, founder and former chairman of SET-listed Thonburi Healthcare Group (THG), became headline news after being accused of embezzling a massive amount of money through medical investment projects as a means to deceive the public. Police revealed that between December 2023 and October this year, 247 complaints were lodged against him at the Huai Khwang police station by victims who could not cash checks he issued. Dr Boon has fled the country, reportedly to China, while police have charged him and eight others on several counts, with damages initially estimated 7.5 billion baht. The suspects are accused of misleading people into investing in medical businesses promoted by Dr Boon, which police said did not exist. WHO IS DR BOON AND HOW DID HE BUILD HIS HOSPITAL EMPIRE? Dr Boon and his 79-year-old wife come from a prominent family. The doctor established THG in 1977 and continually expanded the business, making him well-known in medical and investment circles. Dr Boon earned the trust of his victims and the public after successfully listing the business on the Stock Exchange of Thailand (SET) in 2017. He was often quoted in news and regularly addressed public events. THG operates seven hospitals in Thailand and two overseas. According to the company's website, the group has 1,100 registered beds and a combined capacity to service 9,700 outpatients daily, making the group one of the leading healthcare providers in Thailand. Dr Boon was keen to articulate the narrative of Thailand becoming an aged society, with the global trend opening a vast opportunity for healthcare and well-being services and residences for senior clients. His standing enabled him to convince many investors to back his proposed projects. Dr Boon envisioned projects such as a cancer centre and a wellness centre in Bangkok, a condo on the banks of the Chao Phraya River for seniors, hospitals in Laos and Vietnam, and a medical intelligence project in Chon Buri province. According to police, the fraud was not the work of a single individual, but involves a network that includes family members and brokers who collaborated in the scheme. HOW WAS THE FRAUD EXECUTED? Dr Boon and his associates leveraged their social status and reputation in the medical business to persuade investors to join seemingly credible projects. He offered loan agreements with attractive interest rates to investors, issuing post-dated checks to cover principal and interest payments. However, these checks could not be cashed, leaving investors without the returns they were promised. Initially, Dr Boon paid the loan interest as promised to build confidence among investors. However, when the larger payments were due, he failed to do so, resulting in massive financial losses for investors. Finance permanent secretary Lavaron Sangsnit, who is also a board member of the Securities and Exchange Commission (SEC), said Dr Boon engaged in off-market fundraising by inviting lenders to invest, offering attractive interest rates and claiming the borrowed funds would be invested in various projects. To secure these loans, Dr Boon used shares of Thonburi Hospital, where he was a major shareholder, as collateral. For example, for a loan of 100 baht, he pledged 4 shares of Thonburi Hospital, which were valued at 25 baht per share at the time. As the hospital's share price increased, the number of shares required as collateral decreased proportionally. According to the SET, Dr Boon is the 17th-largest shareholder in THG, holding 5.8 million shares, equivalent to 0.68% of the company, valued at 90 million baht. Victims reported that Dr Boon and his family offered high-return investments with advance interest payments. However, when the principal and interest came due in 2023, there were payment problems, and many checks issued to investors could not be cashed, leading to widespread complaints to the authorities. WHO ARE THE VICTIMS? According to the police, there are several groups of victims, including private lenders who demanded off-market shares as collateral. These lenders provided loans to Dr Boon in exchange for high interest rates of 8-9%. They did not receive repayments as promised in agreements, and many were forced to sell their debts at a discount to minimise losses. Another group comprises major investors in the capital market, including business executives and wealthy individuals who invested in THG shares or projects that were non-existent. Other victims include medical industry leaders, such as doctors managing Thonburi hospitals. They were reportedly lured into investing tens of millions of baht in these projects. Also ensnared were business tycoons and members from high-profile families, including political families, as some shifted into business ventures and were encouraged to invest, according to the police. In addition, the owners of construction materials, telecom and real estate firms were listed as victims, lending significant sums to Dr Boon, noted the authorities. The final group of victims is retail investors, including THG shareholders. Retail shareholders who trusted the company and invested in THG shares suffered indirect losses from the financial damage and reputational harm caused by the scandal. The scandal also shook confidence in the already fragile Thai capital market, particularly regarding transactions involving off-market shares and the use of assets as collateral. WHAT IS THE EXTENT OF THE DAMAGES? The initial damages claimed in lawsuits are estimated at 7.5 billion baht. However, total damages are estimated to reach 20-40 billion baht. The number of victims is currently 500-600 people, with more expected as investigations progress. There is speculation Dr Boon used his personal THG shares as collateral to secure loans amounting to roughly 2 billion baht. This may have been linked to his financial liquidity issues, possibly arising from unsuccessful large-scale investments. It is believed he sought additional funds to stabilise his personal finances. However, Dr Boon denied these allegations, asserting that no such pledging of shares took place. General investors are concerned because the activities involving THG shares led to questions about the company's financial stability. Stock prices have been volatile as investors want to know about past transactions, investments, and the allocation of funds for large projects that have yet to yield clear returns. HOW ARE THE INVESTIGATIONS PROGRESSING? THG's board of directors has initiated a thorough investigation into Dr Boon's past transactions and management practices, aiming to restore investor confidence and stabilise the company's future regarding large-scale projects and the management of working capital. Authorities said this case serves as a critical example of the risks associated with using personal assets to manage organisational finances, potentially impacting shareholders and investors on a broad scale. The police issued arrest warrants for two more individuals linked to Dr Boon's network, charging conspiracy to commit fraud and soliciting fraudulent loans from the public. The warrants were issued after victims revealed new evidence that both individuals acted as brokers or intermediaries, encouraging others to invest in the fraudulent schemes. In addition, an arrest warrant was issued for Nawara Vanasin, Dr Boon's former daughter-in-law who previously claimed her signature was forged. However, an investigation into her financial transactions revealed links to Dr Boon. Authorities are examining the authenticity of her signature. Dr Boon's network involved three main groups: Dr Boon and his family; company employees and document witnesses; and brokers or intermediaries. The police emphasised that any further implicated individuals will face legal action without exception. According to Mr Lavaron, the SEC is drafting regulations to control the behaviour of major shareholders in the market, aiming to prevent similar incidents. "To protect minor shareholders in the market, the SEC is preparing a draft regulation to control the actions of major shareholders if they intend to use their shares as collateral for loans, as in the case of Dr Boon," he said. Major shareholders will be required to notify the SET, which will allow authorities to monitor whether such actions might affect other shareholders. The measure is meant to enhance transparency for investors, said Mr Lavaron.

As envisioned, the center would serve a host of functions, ranging from providing recreation and wellness programming and facilities to a shelter during times when wildlife smoke diminishes air quality and threatens health — an increasingly common scenario given climate change. Butte-Silver Bow County appears destined to benefit from EPA’s Environmental and Climate Justice Community Change Grants Program. The city-county learned recently that it would receive a multi-million grant from the program. Fine-tuning will follow, according to Taylor Gillespie, a regional spokeswoman for EPA. “After a grant is selected, they go through work plan negotiations which is a back-and-forth process between Butte-Silver Bow and the EPA project officer to make sure that the details are solid and that they are on track to meet the requirements of the grant,” Gillespie said. “This would include going line by line through their budget, looking at all of the specifics in the work plan, etc.” EPA has not yet announced the grant amount, but Butte-Silver Bow’s application last spring sought $20 million. And that’s the amount J.P. Gallagher anticipates local government will receive. “This is going to be a huge benefit to the community,” said Gallagher, chief executive of Butte-Silver Bow. “We are very confident that we will be fully funded but before we go into final engineering and design, we need the full confirmation of that funding,” he said. “The cost of construction could affect the square footage of what can be built. There are still some unknowns.” An estimate of total square-footage was not available Thursday. Gallagher said the city-county received feedback that its application, completed in consultation with Water & Environmental Technologies, was one of the most complete received by EPA for funding from the agency’s Environmental and Climate Justice Community Change Grants Program. No taxpayer money was involved in preparing the ambitious grant application, Gallagher said. The proposal had to fall within the grant program’s environmental and climate justice framework. The grant application alluded to the human and economic costs of federal Superfund designation for Butte because of historic mining and smelting pollution. “With an active Superfund site, prolonged disinvestment and significant indicators of poverty and negative environmental impacts, Butte-Silver Bow has been designated as a disadvantaged community and continues to struggle with the impacts of social, economic and environmental decline,” the application noted. Given that status, how will Butte-Silver Bow pay to operate the new facility? One estimate puts annual operating costs at about $560,000. The feasibility study completed by Water & Environmental Technologies cites a variety of ways, in fees and rentals, that the facility could cover expenses. Gallagher weighed in. “The analysis is that the facility would make money to pay for operation,” he said. The feasibility study observes, “One of the most important criterion when selecting and evaluating potential programming is the ability of that programming to recover at least 100% of its expense.” The study adds, “Providing spaces for event, birthday, meeting, fitness and gymnasium rentals offers potential for recovering expenses.” Gallagher said the recreational functions of the facility will likely be less like a fitness center and more like a gym — with basketball and volleyball courts and probably pickleball, too. Programming at the Community Wellness and Resilience Hub would focus on such things as community resiliency, emergency preparedness and wellbeing activities. Several regional environmental consulting businesses and contractors benefit from the so-called remediation economy tied to Butte’s status as a federal Superfund site. And a few cleanup projects have benefitted the community in tangible ways. But a cost/benefits analysis of the Superfund status hitched like a lamprey to Butte since 1987 would have to consider a host of costs, including environmental stigma. He was 78. “He leaves behind a legacy of love, inspiration and dedication to over 50 extraordinary years in the sports broadcast industry; and his iconic voice will never be forgotten,” his wife Marcy Gumbel and daughter Michelle Gumbel said in a statement. In March, Gumbel missed his first NCAA Tournament since 1997 due to what he said at the time were family health issues. Gumbel was the studio host for CBS since returning to the network from NBC in 1998. Gumbel signed an extension with CBS last year that allowed him to continue hosting college basketball while stepping back from NFL announcing duties. In 2001, he announced Super Bowl XXXV for CBS, becoming the first Black announcer in the U.S. to call play-by-play of a major sports championship. David Berson, president and CEO of CBS Sports, described Gumbel as breaking barriers and setting standards for others during his years as a voice for fans in sports, including in the NFL and March Madness. “A tremendous broadcaster and gifted storyteller, Greg led one of the most remarkable and groundbreaking sports broadcasting careers of all time," said Berson. Gumbel had two stints at CBS, leaving the network for NBC when it lost football in 1994 and returning when it regained the contract in 1998. He hosted CBS’ coverage of the 1992 and 1994 Winter Olympics and called Major League Baseball games during its four-year run broadcasting the national pastime. OpenAI has never revealed exactly which data it used to train Sora, its video-generating AI. But from the looks of it, at least some of the data might’ve come from Twitch streams and walkthroughs of games. Sora launched on Monday, and I’ve been playing around with it for a bit ( to the extent the capacity issues will allow ). From a text prompt or image, Sora can generate up to 20-second-long videos in a range of aspect ratios and resolutions. When OpenAI first revealed Sora in February, it alluded to the fact that it trained the model on Minecraft videos. So, I wondered, what other video game playthroughs might be lurking in the training set? Quite a few, it seems. Sora can generate a video of what’s essentially a Super Mario Bros. clone (if a glitchy one): It can create gameplay footage of a first-person shooter that looks inspired by Call of Duty and Counter-Strike: And it can spit out a clip showing an arcade fighter in the style of a ’90s Teenage Mutant Ninja Turtle game: Sora also appears to have an understanding of what a Twitch stream should look like — implying that it’s seen a few. Check out the screenshot below, which gets the broad strokes right: Another noteworthy thing about the screenshot: It features the likeness of popular Twitch streamer Raúl Álvarez Genes, who goes by the name Auronplay — down to the tattoo on Genes’ left forearm. And in the tech specs for Sora, OpenAI acknowledged it used “publicly available” data, along with licensed data from stock media libraries like Shutterstock, to develop Sora. But shortly after this story was published, a PR rep said that they would “check with the team.” If game content is indeed in Sora’s training set, it could have legal implications — particularly if OpenAI builds more interactive experiences on top of Sora. “Companies that are training on unlicensed footage from video game playthroughs are running many risks,” Joshua Weigensberg, an IP attorney at Pryor Cashman, told TechCrunch. “Training a generative AI model generally involves copying the training data. If that data is video playthroughs of games, it’s overwhelmingly likely that copyrighted materials are being included in the training set.” Probabilistic models Generative AI models like Sora are probabilistic. Trained on a lot of data, they learn patterns in that data to make predictions — for example, that a person biting into a burger will leave a bite mark. This is a useful property. It enables models to “learn” how the world works, to a degree, by observing it. But it can also be an Achilles’ heel. When prompted in a specific way, models — many of which are trained on public web data — produce near-copies of their training examples. That has understandably displeased creators whose works have been swept up in training without their permission. An increasing number are seeking remedies through the court system. Microsoft and OpenAI are currently being sued over allegedly allowing their AI tools to regurgitate licensed code. Three companies behind popular AI art apps, Midjourney, Runway, and Stability AI, are in the crosshairs of a case that accuses them of infringing on artists’ rights. And major music labels have filed suit against two startups developing AI-powered song generators, Udio and Suno, of infringement. Many AI companies have long claimed fair use protections, asserting that their models create transformative — not plagiaristic — works. Suno makes the case, for example, that indiscriminate training is no different from a “kid writing their own rock songs after listening to the genre.” But there are certain unique considerations with game content, says Evan Everist, an attorney at Dorsey & Whitney specializing in copyright law. “Videos of playthroughs involve at least two layers of copyright protection: the contents of the game as owned by the game developer, and the unique video created by the player or videographer capturing the player’s experience,” Everist told TechCrunch in an email. “And for some games, there’s a potential third layer of rights in the form of user-generated content appearing in software.” Everist gave the example of Epic’s Fortnite , which lets players create their own game maps and share them for others to use. A video of a playthrough of one of these maps would concern no fewer than three copyright holders, he said: (1) Epic, (2) the person using the map, and (3) the map’s creator. “Should courts find copyright liability for training AI models, each of these copyright holders would be potential plaintiffs or licensing sources,” Everist said. “For any developers training AI on such videos, the risk exposure is exponential.” Weigensberg noted that games themselves have many “protectable” elements, like proprietary textures, that a judge might consider in an IP suit. “Unless these works have been properly licensed,” he said, “training on them may infringe.” TechCrunch reached out to a number of game studios and publishers for comment, including Epic, Microsoft (which owns Minecraft), Ubisoft, Nintendo, Roblox, and Cyberpunk developer CD Projekt Red. EA told TechCrunch it “didn’t have any comment at this time.” Risky outputs It’s possible that AI companies could prevail in these legal disputes. The courts may decide that generative AI has a “highly convincing transformative purpose,” following the precedent set roughly a decade ago in the publishing industry’s suit against Google. In that case, a court held that Google’s copying of millions of books for Google Books, a sort of digital archive, was permissible. Authors and publishers had tried to argue that reproducing their IP online amounted to infringement. But a ruling in favor of AI companies wouldn’t necessarily shield users from accusations of wrongdoing. If a generative model regurgitated a copyrighted work, a person who then went and published that work — or incorporated it into another project — could still be held liable for IP infringement. “Generative AI systems often spit out recognizable, protectable IP assets as output,” Weigensberg said. “Simpler systems that generate text or static images often have trouble preventing the generation of copyrighted material in their output, and so more complex systems may well have the same problem no matter what the programmers’ intentions may be.” Some AI companies have indemnity clauses to cover these situations, should they arise. But the clauses often contain carve-outs. For example, OpenAI’s applies only to corporate customers — not individual users. There’s also risks beside copyright to consider, Weigensberg says, like violating trademark rights. “The output could also include assets that are used in connection with marketing and branding — including recognizable characters from games — which creates a trademark risk,” he said. “Or the output could create risks for name, image, and likeness rights.” The growing interest in world models could further complicate all this. One application of world models — which OpenAI considers Sora to be — is essentially generating video games in real time. Ringo Chiu/AP Homelessness in America reached the highest level on record last year, according to new data released by the Department of Housing and Urban Development—and it will likely only get worse, in light of both a Supreme Court decision issued in June and President-elect Donald Trump’s forthcoming presidency. The annual report —which estimates the number of people staying in shelters, temporary housing, and on the streets on a single night—found more than 770,000 people experiencing homelessness on a single night this past January, up 18 percent from a night in January 2023. The increase in the rate of families experiencing homelessness was even steeper, rising 39 percent from 2023 to 2024. And there was a 33 percent increase in children experiencing homelessness, bringing the amount recorded earlier this year to nearly 150,000 kids. (Experts say the numbers are likely an undercount.) HUD attributes this rise to “significant increases in rental costs, as a result of the pandemic and nearly decades of under-building of housing,” as well as natural disasters—such as the deadly August 2023 Maui wildfires —that destroyed housing. Other factors include “rising inflation, stagnating wages among middle- and lower-income households, and the persisting effects of systemic racism [that] have stretched homelessness services systems to their limits,” the report says. (Black people remain overrepresented, accounting for 12 percent of the US population but 32 percent of those experiencing homelessness, according to the report.) California and New York had the highest numbers of people experiencing homelessness. Some of the nationwide increase, the report notes, was also due to “a result of [communities’] work to shelter a rising number of asylum seekers.” In New York City , for example, asylum seekers accounted for almost 88 percent of the increase in sheltered homelessness. HUD points out that the counts were conducted after Republicans in Congress blocked a bipartisan Senate deal that would have funded border security and before President Joe Biden’s border crackdown via executive action—a reference Sen. John Cornyn (R-Texas) aimed to use to his advantage. Balakrishnan Rajagopal, the UN Special Rapporteur on the right to adequate housing, responded on X that this was a “misdiagnosis of its causes,” adding that he has a report forthcoming on “this easy scapegoating of migrants for the homelessness crisis.” Despite the bleakness of the data, there were some signs of progress: Homelessness among veterans dropped to the lowest number on record: 32,882—an 8 percent decrease from 2023. The report also spotlights a few places ( Dallas , Los Angeles , and Chester County, Pennsylvania) that saw significant decreases in people experiencing homelessness thanks to targeted efforts to increase the availability of housing and other supportive services. Still, it’s hard not to see the data as an indictment of one of the world’s wealthiest nations, where basic necessities— housing , food , and healthcare —are out of reach to many low- and middle-income families. And, as the report intimates, it is likely that people experiencing homelessness will face even greater challenges in light of Grants Pass v. Johnson , the June Supreme Court decision that essentially greenlit the criminalization of homelessness. Maxwell Frost (D-Fla.) posted in response to the same AP article . “Homelessness is a housing problem.” But don’t hold your breath: Trump’s acolytes have signaled their desires to slash the social safety net and enact mass deportations of undocumented people, which experts have said will likely exacerbate the housing crisis given the role immigrants play in the construction industry. The closest his budding administration has come to offering a solution is VP-elect JD Vance’s claim that mass deportations will solve the housing shortage by freeing up units.

Renuka Rayasam | (TNS) KFF Health News In April, just 12 weeks into her pregnancy, Kathleen Clark was standing at the receptionist window of her OB-GYN’s office when she was asked to pay $960, the total the office estimated she would owe after she delivered. Clark, 39, was shocked that she was asked to pay that amount during this second prenatal visit. Normally, patients receive the bill after insurance has paid its part, and for pregnant women that’s usually only when the pregnancy ends. It would be months before the office filed the claim with her health insurer. Clark said she felt stuck. The Cleveland, Tennessee, obstetrics practice was affiliated with a birthing center where she wanted to deliver. Plus, she and her husband had been wanting to have a baby for a long time. And Clark was emotional, because just weeks earlier her mother had died. “You’re standing there at the window, and there’s people all around, and you’re trying to be really nice,” recalled Clark, through tears. “So, I paid it.” On online baby message boards and other social media forums , pregnant women say they are being asked by their providers to pay out-of-pocket fees earlier than expected. The practice is legal, but patient advocacy groups call it unethical. Medical providers argue that asking for payment up front ensures they get compensated for their services. How frequently this happens is hard to track because it is considered a private transaction between the provider and the patient. Therefore, the payments are not recorded in insurance claims data and are not studied by researchers. Patients, medical billing experts, and patient advocates say the billing practice causes unexpected anxiety at a time of already heightened stress and financial pressure. Estimates can sometimes be higher than what a patient might ultimately owe and force people to fight for refunds if they miscarry or the amount paid was higher than the final bill. Up-front payments also create hurdles for women who may want to switch providers if they are unhappy with their care. In some cases, they may cause women to forgo prenatal care altogether, especially in places where few other maternity care options exist. It’s “holding their treatment hostage,” said Caitlin Donovan, a senior director at the Patient Advocate Foundation . Medical billing and women’s health experts believe OB-GYN offices adopted the practice to manage the high cost of maternity care and the way it is billed for in the U.S. When a pregnancy ends, OB-GYNs typically file a single insurance claim for routine prenatal care, labor, delivery, and, often, postpartum care. That practice of bundling all maternity care into one billing code began three decades ago, said Lisa Satterfield, senior director of health and payment policy at the American College of Obstetricians and Gynecologists . But such bundled billing has become outdated, she said. Previously, pregnant patients had been subject to copayments for each prenatal visit, which might lead them to skip crucial appointments to save money. But the Affordable Care Act now requires all commercial insurers to fully cover certain prenatal services. Plus, it’s become more common for pregnant women to switch providers, or have different providers handle prenatal care, labor, and delivery — especially in rural areas where patient transfers are common. Some providers say prepayments allow them to spread out one-time payments over the course of the pregnancy to ensure that they are compensated for the care they do provide, even if they don’t ultimately deliver the baby. “You have people who, unfortunately, are not getting paid for the work that they do,” said Pamela Boatner, who works as a midwife in a Georgia hospital. While she believes women should receive pregnancy care regardless of their ability to pay, she also understands that some providers want to make sure their bill isn’t ignored after the baby is delivered. New parents might be overloaded with hospital bills and the costs of caring for a new child, and they may lack income if a parent isn’t working, Boatner said. In the U.S., having a baby can be expensive. People who obtain health insurance through large employers pay an average of nearly $3,000 out-of-pocket for pregnancy, childbirth, and postpartum care, according to the Peterson-KFF Health System Tracker . In addition, many people are opting for high-deductible health insurance plans, leaving them to shoulder a larger share of the costs. Of the 100 million U.S. people with health care debt, 12% attribute at least some of it to maternity care, according to a 2022 KFF poll . Families need time to save money for the high costs of pregnancy, childbirth, and child care, especially if they lack paid maternity leave, said Joy Burkhard , CEO of the Policy Center for Maternal Mental Health, a Los Angeles-based policy think tank. Asking them to prepay “is another gut punch,” she said. “What if you don’t have the money? Do you put it on credit cards and hope your credit card goes through?” Calculating the final costs of childbirth depends on multiple factors, such as the timing of the pregnancy , plan benefits, and health complications, said Erin Duffy , a health policy researcher at the University of Southern California’s Schaeffer Center for Health Policy and Economics. The final bill for the patient is unclear until a health plan decides how much of the claim it will cover, she said. But sometimes the option to wait for the insurer is taken away. During Jamie Daw’s first pregnancy in 2020, her OB-GYN accepted her refusal to pay in advance because Daw wanted to see the final bill. But in 2023, during her second pregnancy, a private midwifery practice in New York told her that since she had a high-deductible plan, it was mandatory to pay $2,000 spread out with monthly payments. Daw, a health policy researcher at Columbia University, delivered in September 2023 and got a refund check that November for $640 to cover the difference between the estimate and the final bill. “I study health insurance,” she said. “But, as most of us know, it’s so complicated when you’re really living it.” While the Affordable Care Act requires insurers to cover some prenatal services, it doesn’t prohibit providers from sending their final bill to patients early. It would be a challenge politically and practically for state and federal governments to attempt to regulate the timing of the payment request, said Sabrina Corlette , a co-director of the Center on Health Insurance Reforms at Georgetown University. Medical lobbying groups are powerful and contracts between insurers and medical providers are proprietary. Because of the legal gray area, Lacy Marshall , an insurance broker at Rapha Health and Life in Texas, advises clients to ask their insurer if they can refuse to prepay their deductible. Some insurance plans prohibit providers in their network from requiring payment up front. If the insurer says they can refuse to pay up front, Marshall said, she tells clients to get established with a practice before declining to pay, so that the provider can’t refuse treatment. A range of independent TDs are contemplating the prospect of entering Ireland’s next coalition government as Fianna Fail and Fine Gael consider ways to secure a solid majority. Three long days of counting in the General Election finished late on Monday night when the final two seats were declared in the constituency of Cavan-Monaghan. Fianna Fail was the clear winner of the election, securing 48 of the Dail parliament’s 174 seats. Sinn Fein took 39 and Fine Gael 38. Labour and the Social Democrats both won 11 seats; People Before Profit-Solidarity took three; Aontu secured two; and the Green Party retained only one of its 12 seats. Independents and others accounted for 21 seats. The return of a Fianna Fail/Fine Gael-led coalition is now highly likely. However, their combined seat total of 86 leaves them just short of the 88 needed for a majority in the Dail. While the two centrist parties that have dominated Irish politics for a century could look to strike a deal with one of the Dail’s smaller centre-left parties, such as the Social Democrats or Labour, a more straightforward route to a majority could be achieved by securing the support of several independent TDs. For Fianna Fail leader Micheal Martin and current taoiseach and Fine Gael leader Simon Harris, wooing like-minded independents would be likely to involve fewer policy concessions, and financial commitments, than would be required to convince another party to join the government benches. Longford-Westmeath independent TD Kevin “Boxer” Moran , who served in a Fine Gael-led minority government between 2017 and 2020, expressed his willingness to listen to offers to join the new coalition in Dublin. “Look, my door’s open,” he told RTE. “Someone knocks, I’m always there to open it.” Marian Harkin, an independent TD for Sligo-Leitrim, expressed her desire to participate in government as she noted that Fianna Fail and Fine Gael were within “shouting distance” of an overall majority. “That means they will be looking for support, and I certainly will be one of those people who will be speaking to them and talking to them and negotiating with them, and I’m looking forward to doing that, because that was the reason that I ran in the first place,” she said. Meanwhile, the Social Democrats and Irish Labour Party both appear cautious about the prospect of an alliance with Fianna Fail and Fine Gael. They will no doubt be mindful of the experience of the Green Party, the junior partner in the last mandate. The Greens experienced near wipeout in the election, retaining only one of their 12 seats. Sinn Fein appears to currently have no realistic route to government, given Fianna Fail and Fine Gael’s ongoing refusal to share power with the party. Despite the odds being stacked against her party, Sinn Fein president Mary Lou McDonald contacted the leaders of the Social Democrats and Labour on Monday to discuss options. Earlier, Fianna Fail deputy leader and outgoing Finance Minister Jack Chambers predicted that a new coalition government would not be in place before Christmas. Mr Chambers said planned talks about forming an administration required “time and space” to ensure that any new government will be “coherent and stable”. After an inconclusive outcome to the 2020 election, it took five months for Fianna Fail, Fine Gael and the Greens to strike the last coalition deal. Mr Chambers said he did not believe it would take that long this time, as he noted the Covid-19 pandemic was a factor in 2020, but he also made clear it would not be a swift process. He said he agreed with analysis that there was no prospect of a deal before Christmas. “I don’t expect a government to be formed in mid-December, when the Dail is due to meet on December 18, probably a Ceann Comhairle (speaker) can be elected, and there’ll have to be time and space taken to make sure we can form a coherent, stable government,” he told RTE. “I don’t think it should take five months like it did the last time – Covid obviously complicated that. But I think all political parties need to take the time to see what’s possible and try and form a stable government for the Irish people.” Fine Gael minister of state Peter Burke said members of his parliamentary party would have to meet to consider their options before giving Mr Harris a mandate to negotiate a new programme for government with Fianna Fail. “It’s important that we have a strong, stable, viable government, whatever form that may be, to ensure that we can meet the challenges of our society, meet the challenges in terms of the economic changes that are potentially going to happen,” he told RTE. Despite being set to emerge with the most seats, it has not been all good news for Fianna Fail. The party’s outgoing Health Minister Stephen Donnelly became one of the biggest casualties of the election when he lost his seat in Wicklow in the early hours of Monday morning. Mr Donnelly was always predicted to face a fight in the constituency after boundary changes saw it reduced from five to four seats. If it is to be a reprise of the Fianna Fail/Fine Gael governing partnership of the last mandate, one of the major questions is around the position of taoiseach and whether the parties will once again take turns to hold the Irish premiership during the lifetime of the new government. The outcome in 2020 saw the parties enter a coalition on the basis that the holder of the premier position would be exchanged midway through the term. Fianna Fail leader Mr Martin took the role for the first half of the mandate, with Leo Varadkar taking over in December 2022. Current Fine Gael leader Mr Harris succeeded Mr Varadkar as taoiseach when he resigned from the role earlier this year. However, this time Fianna Fail has significantly increased its seat lead over Fine Gael, compared with the last election when there were only three seats between the parties. The size of the disparity in party numbers is likely to draw focus on the rotating taoiseach arrangement, raising questions as to whether it will be re-run in the next coalition and, if it is, on what terms. On Sunday, Simon Coveney, a former deputy leader of Fine Gael, said a coalition that did not repeat the rotating taoiseach arrangement in some fashion would be a “difficult proposition” for his party. Meanwhile, Fine Gael minister Paschal Donohoe said he would be making the case for Mr Harris to have another opportunity to serve as taoiseach. On Monday, Mr Chambers said while his party would expect to lead the government it would approach the issue of rotating the taoiseach’s role on the basis of “mutual respect” with Fine Gael. “I think the context of discussions and negotiations will be driven by mutual respect, and that’s the glue that will drive a programme for government and that’s the context in which we’ll engage,” he said. On Monday, Labour leader Ivana Bacik reiterated her party’s determination to forge an alliance with fellow centre-left parties with the intention of having a unified approach to the prospect of entering government. Asked if Labour was prepared to go into government with Fianna Fail and Fine Gael on its own, she told RTE: “No, not at this stage. We are absolutely not willing to do that. “We want to ensure there’s the largest number of TDs who share our vision and our values who want to deliver change on the same basis that we do.” The Social Democrats have been non-committal about any potential arrangement with Fianna Fail and Fine Gael, and have restated a series of red lines they would need to achieve before considering taking a place in government. Leader Holly Cairns, who gave birth to a daughter on polling day on Friday, said in a statement: “The party is in a very strong position to play an important role in the next Dail. In what position, government or opposition, remains to be seen.” Fianna Fail secured the most first preference votes in Friday’s proportional representation election, taking 21.9% to Fine Gael’s 20.8%. Sinn Fein came in third on 19%. While Sinn Fein’s vote share represented a marked improvement on its disappointing showing in June’s local elections in Ireland, it is still significantly down on the 24.5% poll-topping share it secured in the 2020 general election. The unexpected move from Yoon, marking the first time martial law has been declared in South Korea in more than four decades, alarmed the US and other allies. Six hours later he backed down , lifting the order in the face of united opposition. What do we know about the imposition of martial law, and what might come next? In a dramatic, late-night emergency television address to the nation, Yoon announced that he was imposing martial law in South Korea, as he accused the opposition of paralysing the government with “anti-state activities”. A six-point decree from the new martial law commander, the army chief Gen Park An-su, swiftly followed: banning political activities and parties, “false propaganda”, strikes and “gatherings that incite social unrest”. The order also brought all media outlets under the authority of martial law and directed all medical staff, including striking doctors, to return to work within 48 hours. The president’s move harkened back to an era of authoritarian leaders that the country has not seen since the 1980s. It was immediately denounced by the opposition and the leader of Yoon’s own party. Yoon said he was acting to safeguard his country’s liberal democracy from “anti-state elements” and “threats posed by North Korea” - but gave little detail. While unexpected, the announcement came in the context of a festering budget row between Yoon and the opposition Democratic Party. The opposition has slashed around 4.1 trillion won ($2.8 billion) from Yoon’s proposed 677 trillion won budget for next year, prompting the president to complain that “all key budgets essential to the nation’s core functions” were being cut. Security forces sealed the National Assembly, helicopters landed on the roof and troops entered the building for a short time, seemingly in a bid to prevent lawmakers getting inside. But 190 lawmakers managed to enter, voting unanimously to reject Yoon’s declaration and calling for martial law to be lifted. Outside parliament, hundreds of protesters gathered, many raising chants calling for Yoon to be arrested. Some protesters scuffled with troops but there were no immediate reports of injuries or major property damage. At least one window was broken as troops attempted to enter the assembly building. One woman tried unsuccessfully to pull a rifle away from one of the soldiers while shouting “Aren’t you embarrassed?” Under South Korea’s constitution, the parliamentary vote to lift martial law has to be respected. Raphael Rashid, reporting for the Guardian from Seoul, writes that on the morning after the coup, the feeling in South Korea has been one of bafflement and sadness. “For the older generation who fought on the streets against military dictatorships, martial law equals dictatorship, not 21st century Korea. The younger generation is embarrassed that he has ruined their country’s reputation. People are baffled. “Also everyone is wondering what his end goal was. Expedited impeachment is the word on people’s lips. From within politics, Yoon is facing calls to step down or be impeached.” Politically, pressure has only grown further on Yoon after his late-night bombshell. South Korea’s main opposition party has demanded that Yoon step down, accusing him of “insurrection”. The country’s main labour union group has also called an “indefinite general strike” until he resigns over the “irrational and anti-democratic measure”.
