NEW DELHI: State-run Bharat Sanchar Nigam Limited ( BSNL ) is at a competitive disadvantage compared to its private sector rivals owing to key challenges affecting the launch of its fourth-generation (4G) network, a Parliamentary panel has found. “BSNL is at a competitive disadvantage as it still relies on 2G/3G networks for a significant portion of its services, whereas competitors are rapidly expanding their 4G and 5G services,” the Committee on Public Undertakings said in a report tabled in Lok Sabha recently. Advt It found that a lack of 4G spectrum availability has further exacerbated BSNL’s disadvantageous position against competitors, noting that the industry generates 98% of its revenue from 4G services that the telecom PSU cannot tap into. A Tata Consultancy Services (TCS)-led consortium comprising homegrown vendor Tejas Networks and the Centre of Development for Telematics (C-DoT) together with ITI Limited are deploying a homegrown 4G network for BSNL across 1 lakh sites under the ‘Atmanirbhar Bharat’ (or self-reliant India) initiative. The home-bred 4G network can be upgraded to 5G through a software update. The report comes when Reliance Jio and Bharti Airtel have already concluded their nationwide 5G deployments using equipment from multinationals such as Swedish Ericsson, Finland’s Nokia , and South Korean Samsung. Vodafone Idea (Vi), too, is expected to soon commence its commercial 5G rollout with the European vendors. BSNL’s 4G roll-out has been progressing at a snail’s pace. Advt BSNL, in a written reply to the Committee, said that the major hurdle regarding its 4G expansion is because the technology may still take time to be tested and proven. Only four countries have their homegrown telecom stack. “Since indigenous 4G and 5G equipment are being used for the first time in BSNL’s network, stability and performance of the network in live environment with provision of all features at par with the private operators is a big challenge. The scale of testing and manufacturing involved is also humongous,” the telco has said in its written reply. The Committee, in turn, recommended BSNL adopt a multi-pronged strategy, including expediting the testing and stabilisation of indigenous 4G technology, and partnering with foreign technology companies. “BSNL should enhance collaboration with Indian technology developers and global experts to expedite the validation and refinement process...BSNL may explore partnerships with foreign technology providers for temporary integration which could help bridge the technology gap while the indigenous solutions reaches maturity,” it said in the report. The Committee further suggested BSNL “reassess investment strategies” in 5G technology with a clear focus on use cases and potential return on investment before substantial expenditure. On being asked about the difference in terms of share of connections between BSNL and private telcos, the public sector told the Committee that Jio has invested Rs 4 lakh crore in the last five years while BSNL has only invested Rs 8,000 crore which is a huge difference. The Centre, to date, has provided fiscal support amounting to over Rs 2 lakh crore to BSNL and Mahanagar Telephone Nigam Limited (MTNL) to enable the companies to compete effectively in the market, generate revenue on the back of bolstered telecom services, and reduce debt. The Committee said in the report that BSNL must now focus on “reducing its reliance on government aid, and there is a need to enhance its operational efficiency, explore new revenue streams, and strategically invest in infrastructure and technology to ensure long-term sustainability”. An upcoming hearing at The Supreme Court, which will decide if survivors of domestic violence are able to sue their abusers for “family violence,” could result in consequences for survivors, warns one legal advocacy non-profit. In February, 2025, Canada’s Supreme Court will decide if family violence is recognized as a tort – a civil wrong, for which someone could be held liable. If recognized, the decision would allow for family court cases over family violence, giving survivors of domestic violence the option to sue their abusers for family violence. But the National Association of Women and the Law (NAWL), which is set to appear before the Supreme Court alongside other organizations and stakeholders to present the implications of the decision, is concerned the new tort could give abusers an avenue to sue their victims. “Often, what we see is abusers using remedies that are meant for survivors and kind of twisting them and using them to their advantage,” said Suzanne Zaccour, director of legal affairs at NAWL, in an interview with rabble.ca . “We think abusers may try to use this tort of family violence to sue their own victims.” How parental alienation arguments target survivors Zaccour’s main concern is the argument of parental alienation, a tactic that is increasingly used in custody battles in Canadian courtrooms. The argument is often used by abusers in family court cases when a woman alleges their partner is abusive, Zaccour explained. Sometimes, the abusive party will claim that the other party has been psychologically manipulating their child and turning them against them by repeatedly badmouthing them to their child or falsely accusing them of abuse. In some cases, if the court believes allegations of abuse were falsified to alienate a child from their parent, abusers can be awarded custody of their children. A UN report , released this summer, called the concept “highly gendered”, “unfounded and unscientific”, highlighting that it is “predominantly used against mothers”. Zaccour worries that if the Supreme Court decides to recognize a tort of family violence, abusers will be able to argue that parental alienation is family violence – and that this could force victims to pay damages to their abusers. “We’re seeing that courts are already imposing costs on survivors, taking kids away from them,” Zaccour said. “We think it is likely that courts could also make them pay damages.” “They’re going to say ‘well, my ex alienated the children’ if their children don’t want to see them because they’re violent,” Zaccor explained. “They’re going to say ‘this constitutes family violence, so, she needs to pay me.’” What safeguards are needed NAWL is supportive of recognizing family violence as a tort that can be used in family court – but only with appropriate safeguards. Zaccour hopes that their intervention at the Supreme Court will highlight the implications of the decision and result in protections for survivors being written in. “We’re hoping to inform the court of these risks and, ultimately, make sure that there are some safeguards in the decision,” she said, “to encourage them if they decide to recognize this tort that they do so carefully, making sure judges are instructed appropriately.” Still, Zaccour thinks there is a simpler solution – banning the concept of parental alienation from family court altogether. “They need to legislate that you cannot use this unscientific theory in court cases,” she said. In January, a coalition of over 250 Canadian feminist organizations, including NAWL, sent letters to Prime Minister Justin Trudeau and Minister of Justice Arif Viranion, urging the government to remove the concept from family law cases. The concept has yet to be removed. Zaccour warned that, if not removed, the concept will continue to be used as a strategy to further target survivors of domestic violence, both in custody battles and in future family violence cases, should the tort be recognized. “If the government doesn’t act, abusers will continue to use this,” she said. “We have to make sure that women don’t face even more consequences.” Support rabble today! Ezra Mam will have to pay $120,000 in fines to Brisbane and the NRL, after the under-fire five-eighth accepted his nine-game ban for driving offences. The Broncos confirmed late on Friday evening that Mam would accept his NRL sanctions, which included a $30,000 fine. Brisbane have slapped the 22-year-old with an additional $90,000 fine for being caught drug driving while unlicensed after crashing his ute into an oncoming car in October. In a statement, the Broncos said Mam would also have to complete a safe-driving program, work or study placement and commit to ongoing wellbeing support. Mam was also fined $850 and had his license suspended for nine months in court last week , with a magistrate telling Mam he had a “cocktail of cocaine and other matters” in his system, and that he “could’ve injured or killed” someone. That punishment was widely been criticised as too lenient, after a woman and her young daughter were injured in the collision.
