Last night Rob Hay, of the Association of Scottish Police Superintendents, said he and colleagues had “grave concerns” at cons returning to communities. He added: “The public are being put at risk. “Every crime committed and every victim who suffered at the hands of those criminals represent an avoidable consequence of this misguided government policy.” He added: “To release prisoners early, knowing further offending is likely to occur, piles pressure on a police service already stretched to breaking under unsustainable demand. “The only comfort I can offer the public is that where police officers encounter released prisoners who remain involved in crime, we will do all we can to ensure they end up back in custody, where they belong.” The latest plans will change the release point for offenders serving sentences of less than four years from 50 per cent of their sentence to 40 per cent. This will immediately release hundreds of criminals when the Bill comes into force at the start of next year. There will be no change to the release point for inmates serving sentences for domestic abuse or sexual offences. The Bill also includes powers for ministers to change the point of release under licence conditions for cons serving sentences of four years or more. Nats ministers were worried over-capacity jails could hit a population of 9,000 by January — well above the safe target capacity of 8,007. Scottish Labour’s justice spokeswoman Pauline McNeill last night accused the SNP of having “lost control.” She said: “Police Scotland is overwhelmed, our courts have huge backlogs, and prisons are dangerously overcrowded — the SNP has lost control of our justice system. “The SNP must get a grip of the crisis it has created and take action to keep our communities safe.” Scottish Tory justice spokesman Liam Kerr said the plan went ahead “without a moment’s thought for victims or public safety”. He added: “This Bill sums up how disconnected the SNP are from the public. “The public wants them to show some common sense and ensure prisoners serve their sentences in full.” Scottish Lib Dem justice spokesman Liam McArthur called the move a “short-term fix”. He said: “Because of SNP neglect, there is no good solution available. “Either prisoners are released, new ones dodge imprisonment or officers are left manning ever more crowded and dangerous prisons. “I am worried that in the months to come the police will have their hands full with chasing down repeat offenders.” The latest move comes after more than 470 prisoners were freed early in June and July. In total, 171 further criminals were blocked from leaving jail due to prison bosses believing they posed a risk to public safety. However MSPs voted down amendments last night which sought to impose a similar system on the latest release. And they rejected proposals which would have seen criminals who had returned to jail after being released in the last 12 months excluded from the early release system. The decision came on the day statistics showed huge increases in some crimes since Covid — many of which resulted in sentences which would be covered by the new Bill. Shoplifting has soared 70 per cent amid the cost of living crisis — with cases up from 24,861 in 2020 to 42,271 in the last year. It carries a maximum sentence of seven years for goods worth more than £200, and just six months for items worth less than £200. Domestic abuse has also rocketed in the last year — rising by 25 per cent while also increasing by 44 per cent since the pandemic from 1,603 to 2,313 cases. Crimes against society, such as some public order offences, have also risen sharply, up 62 per cent since 2020 from 187 to 303. Non-sexual violence excluding robbery, common assault, and serious assault has spiked by 61 per cent from 2,645 cases to 4,247. Rape and attempted rape has also rocketed by 20 per cent, from 2,284 to 2,746 cases, while fraud is up 19 per cent from 13,358 to 15,915. Other crimes which have seen significant rises include instances where someone has threatened to or disclosed intimate images — up 17 per cent from 645 to 753 crimes. Harassment or minor sexual assault cases rose by the same percentage — from 1,358 to 1,592. The number of crimes linked to indecent photos was up 15 per cent, rising from 657 to 756. Overall, the number of recorded crimes rose to 300,134. That is up by 2,709 on last year and up 3,176 when compared to September 2020. Ministers released hundreds of criminals this summer after the prison population rocketed to 8,232. That only applied to those with sentences less than four years and had less than 180 days left to serve. It excluded brutes convicted of sexual or domestic abuse offences. But a third were guilty of violent crimes. However, 57 of the 477 released then were back behind bars within weeks. Twenty were due to violent offences, with 17 due to stealing or committing fraud. A further eight were found to have committed crimes against society which includes public order offences, and eight were due to anti-social behaviour. One case saw a prisoner was back behind bars within 12 hours after becoming violent following a boozing session. The other four reoffenders were rejailed for unknown crimes. It saw Justice Secretary Ms Constance forced to announce the fresh plans in September after the prison population soared to 8,322 — with more than a quarter on remand. After last night’s vote was passed she said: “We have experienced a significant rise in our prison population in recent times. “This means that without intervention, there is a risk that prisons will no longer be safe places for the dedicated staff to carry out the important work of rehabilitation to reduce reoffending. That is why this Bill is backed by both the Prison Officers’ Association and the Prison Governors Association. The measures will bring about a sustained reduction in the prison population as well as relieve some of the acute pressure being experienced within our prison estate.
