Assistant U.S. Attorney Sara Fullerton had argued for a longer sentence for Robert Vincent Harris, who she said had not accepted any responsibility for his actions. "This is a person that to my knowledge has never acknowledged that he did anything wrong either on a legal or even a purely human basis," she said. Fullerton said Harris was lucky the woman didn't die. Harris's attorney, Bob Creager, said Harris had acknowledged what he did was wrong. At a bench trial, he argued Harris should be found guilty of straight possession because he hadn't sold the woman drugs. Harris, who was an addict himself, allowed her to use some of his. According to court records, on Feb. 14, 2023, Harris bought 10 pills that looked like oxycodone but he believed were fentanyl, from his source and crushed them into powder to cut and snort throughout the day. Later that day, Harris cut a line and snorted some. Then, a woman, identified in court records as "Ariel L.," snorted the rest. Not long after, the drugs kicked in and Ariel fell down. Harris used Narcan, which can counteract a fentanyl overdose, from the woman's purse on her. And a bystander called 911. When the Lincoln/Lancaster County Drug Task Force searched Harris' apartment with a warrant later that night, they found two straws with residue. One tested positive for fentanyl and the other for fentanyl, meth, cocaine and heroin. Senior U.S. District Judge John Gerrard ultimately rejected the defense argument and found Harris guilty of distribution of fentanyl resulting in serious injury and possession with intent to distribute fentanyl, methamphetamine, cocaine and heroin. In court Monday, Creager said heroin users who are profoundly addicted don't think or act clearly. It's the "nature of the beast." But it didn't involve distribution in the traditional sense of a seller hooking people onto the drug. He said Harris was in a bad place and has done remarkably well in treatment since. Harris said that as a person with a drug problem he's had some "clean time" before. "This is different now. I'm in recovery now," he told the judge. Harris said he's since seen the woman, who is doing well, and they apologized to each other. He said he's been inspired to continue with his recovery. Gerrard said thatwhat happened to the victim was very serious, but Harris took some steps, starting the night of the overdose, to rectify it. "But the law is what it is," he said. "You were convicted of a crime." Gerrard sentenced Harris to 20 years, the mandatory minimum set by Congress, and let Harris report to the prison in February. There is no parole in federal prison. People were waiting to see the sign that the rates were going to stay stable and probably continue to go down a little bit,” said association CEO Bill Madder. According to LSTAR the average sale price of a home in November was $640,198 - reflecting an increase of 5.9 per cent over November, 2023. Six-hundred-forty-one homes changed hands, for an increase of 35.5 per cent year over year, and new listings were up 10.8 per cent year-to-date. Madder said the market is starting to see the effect of cuts to the prime lending rate. “It’s definitely helping. I think there’s probably more response to that to come yet,” he speculated. Bill Madder, CEO London St. Thomas Real Estate Association (Bryan Bicknell/CTV News London) Madder said sellers still have an advantage in the current market, but the interest rate cut helps bring more balance. “If we compare to 2020-2021, that was clearly a benefit to the sellers. HOUSTON (AP) — E.J. Warner threw three touchdown passes and Rice survived a late rally by South Florida to take a 35-28 victory on Saturday in a regular-season finale. Warner was 27-of-42 passing for 430 yards and had 294 yards and two TD throws in the first half when the Owls (4-6, 3-5 American Athletic Conference) rolled up 367 yards offense and 19 first downs for a 27-7 lead at the break. Trailing 35-14 with five minutes left, USF quarterback Bryce Archie had to leave the game after taking a late hit. Backup Israel Carter threw two touchdown passes in the final three minutes to cut the lead to seven. Rice recovered an onside kick and got the clock down to 27 seconds on six straight Christian Francisco runs before turning the ball over on downs at the USF 28. A final hook-and-lateral play loaded with laterals went deep into Rice territory but was nullified in any case by a penalty.
