The newly amended International Crimes (Tribunals) Act will allow for the prosecution of the army, navy, air force, police, Rapid Action Battalion, Border Guard Bangladesh and all intelligence agencies. "'Intelligence agency" means any "authority, force or entity, established by or under any law which is responsible for the collection, analysis and exploitation of information in support of law enforcement, national security and public safety", specified the amendment. The amended law says, "The provisions of this article shall apply only to persons in a position effectively to exercise control over or to direct the political or military action of a State." The newly amended law also provides explicit instructions to protect accused and detained persons from torture and forcible detention, and orders all accused to be brought to the tribunal within 24 hours of arrest. The accused and detained will have legal rights to protection under the Torture and Custodial Death (Prevention) Act, 2013. "Evidence obtained by means of a violation of internationally recognised human rights shall not be admissible." The law also mandates that the prosecution must disclose to the defence any evidence in its possession that portrays that an accused person may be innocent. The defence can present evidence or additional witnesses at any stage of the trial. The amended law also specified the scope of culpability for crimes against humanity. It detailed that those who can be tried include not only those who have ordered, solicited, incited or assisted in the commission of the crimes specified in the law, but also those who had knowledge that the crime was to be committed. The contribution must be "intentional", says the law. Home | ANC North West brushes off suggestions structures are dysfunctional The ANC in the North West says the party is functioning well despite many branches in the province not being in good standing. 60% of ANC branches in the North West are not in good standing. The terms of office of many Branch Executive Committees (BEC) have expired. The SABC has reliably learnt that in Bojanala, the party’s biggest region in the province, with a total of 153 branches, fewer than ten branches are in good standing. Interim structures are currently leading many branches. PEC member and Spokesperson Tumelo Maruping says plans were made to ensure functionality. “The guidelines that we have issued as the ANC Provincial Executive Committee was that branches that have lapsed since the last national conference must turn the BEC (Branch Executive Committees) into the BTT (Branch Task Team). Where the BEC does not exist, we then instructed them to establish a task team which will lead to a BBMG. The BBMG is where the BEC gets to nominate a BEC,” he says. Meanwhile, political analyst Thabang Motswaledi says the situation is worrying. “It clearly shows you about the kind of leadership that is in the party. The ANC still struggles to find resonance among the people. The (North West) is still one of the provinces that is still the stronghold of the African National Congress. So, therefore, this tells a story, to say the ANC needs to actually look in the mirror and at self,” says Motswaledi. The DailyWire+ satirical documentary Am I Racist? broke records by making more than $12 million at the box office. It also landed a session in Deadline’s awards-season showcase Contenders Documentary . In the movie, director Justin Folk films Matt Walsh infiltrating leaders in diversity movements and causing a scene in disguise. Walsh interrupted a Saira Rao dinner lecture decrying white women by dropping stacks of plates. While Walsh and Folk disagree with the sentiments expressed by activists like Rao, they also spoke with regular Americans in Black and white communities. Walsh said the message is that Americans want to move on from discussing race. “I think for a lot of people, they feel like, ‘Let’s move on. Let’s not dwell on these things,’” Walsh said. “By the way, that was the message we heard in the film, not just from white people. We went down south to Louisiana — a Black community in Louisiana, New Orleans — and we heard the same thing. They said, ‘Look, I’m not focused on this racism thing. Let’s just live our lives.’” Folk agreed that people want to move on, adding that many they spoke with entertained discussions of race out of politeness. “I think people in general, whether it be white men or white women or anybody in between, even minorities, they’re polite,” Folk said. “They don’t want to be called haters. They don’t want to be called bigots. They don’t want to be called racist, and I think they’ve taken advantage of that and pushed an agenda and overstepped with that.” Asked whether they acknowledged that there has been structural racism in the past, they concurred there has been. Walsh said credit is also due for correcting those systems. Now, although slavery existed as an institution all across the world for thousands of years, in this country it certainly was a racist institution. Nobody denies that. But, in modern America as it stands today, there are no laws or policies on the books that have the intention of disadvantaging Black people, people that we call, quote unquote, people of color. That doesn’t exist today, and I think you have to allow society to progress.” Walsh also pushed back on the notion that the legacies of racist policies, such as Black soldiers being excluded from the GI Bill, still have impacts on minorities. He suggested that one wouldn’t have to go back far to find oppression in anyone’s lineage. Or we’re going to just move on and say, ‘Now is today. It’s the present moment, and we now live in a situation in a country where we can take charge of our own lives.’” Folk agreed with the goal to move forward “and not repeat the same mistakes of the past, which were mistakes made because of race.” Check back Monday for the panel video.
